Yamaha Rhino ATV lawsuit alleges another rollover accident on level suface

Lawsuits continue to pile up against Yamaha Motor Company, the manufacturer of the Yamaha Rhino ATV. Although Yamaha’s television ads show the ATV being driven at what appears to be high speeds over rough terrain, in the real world, Yamaha Rhino’s rollover surprisingly easy, causing crushing injuries to exposed hands, arms and heads. In a recent article in The West Virginia Record reported, “Laura Lewis was a passenger on the ATV on Oct. 2, 2006, in Maryland, when it rolled over on its side during a routine maneuver on a level surface. According to the suit, Lewis’s right hand became trapped between the vehicle and the ground, crushing her right upper extremity and causing multiple fractures of her hand and fingers.

The injury required extensive surgery, including the use of metal pin and hardware to fix the bones, the suit says.”

2008 Yamaha Rhino ATVs recalled due to risk of brake failure

On March 25, 2008, the Consumer Product Safety Commission (CPSC) released the following recall information:

“Yamaha Motor Corporation U.S.A. Recalls Rhino Side-by-Side Vehicles Due to Risk of Brake Failure

The following product safety recall was voluntarily conducted by the firm in cooperation with the CPSC (Consumer Product Safety Commission). Consumers should stop using the product immediately unless otherwise instructed.

Name of Product: Model Year 2008 Rhino YXR450 and YXR700 Side-by-Side Vehicles”

This recall fails to address the fact that Rhinos roll over more easily than other ATVs due to their high center-of-gravity and narrow wheel-base. It also fails to address the fact that 2004-2007 Yamaha Rhino ATVs were sold without side doors to protect passengers’ arms, legs and heads in the event of a rollover.
